Terms & Conditions
1. RESERVATION, CONFIRMATION, DEPOSIT, BALANCE:
1.1. Reservations: All bookings are made by email at the head office of Asia Top Travel. Upon confirmation of the service, an invoice will be issued by email to clients or the relevant Agency by Asia Top Travel.
1.2. Deposit: Upon confirmation of the trip, a deposit of 50% of the total amount is required to secure the booking.
1.3. Balance of the trip: the balance is payable upon your arrival in Vietnam and prior to commencement of the trip. In the event balance of payment is not provided before commencement of the trip, Asia Top Travel reserves the right to cancel the trip and retain the deposit made by clients/Agency.
1.4. In case of booking at the beginning of the trip, the full price of the trip must be paid.
2. CANCELLATION POLICY:
2.1. Cancellation by Client:
a) In case of cancellation for whatever reason, the client must immediately notify Asia Top Travel, either via email or WhatsApp. Clients agree to pay the penalties according to the time when the request for cancellation reaches Asia Top Travel:
45 – 30 days before the trip: 15% total price of the trip
29 – 15 days before the trip: 30% total price of the trip
14– 5 days before the trip: 50% total price of the trip
4– 0 day before the trip: 100% total price of the trip
Where flights tickets, have already been issued, hotel accommodations, cruises have been pre-paid…, the cancellation fee will be based on the airline policies cancellation flight fee.
b) Postponement of a trip will incur cancellation costs to clients for services already paid to suppliers.
c) The refund will be made by bank transfer and the client must pay all the bank fees.
d) In case of impediment, clients may nominate another person who will participate in the trip under the same conditions. This person will be responsible for any outstanding costs including any service provider costs involved in name changes for the trip (hotels, airlines, railways
e) In the event that clients cancel due to force majeure circumstances (such as illness, death, accidents, or natural disasters), we will make every effort to negotiate with service providers (including hotels, transfers, flights, and trains) to minimize cancellation charges. In such cases, Asia Top Travel will refund the remaining balance after deducting any actual fees charged by the service providers.
2.2. Cancellation by Asia Top Travel:
The contract provided by Asia Top Travel may be cancelled by us in the event of force majeure circumstances such as war or threat of war, natural disasters, fire, terrorist activities, severe weather conditions, epidemics, or any other unforeseen events beyond our control that prevent us from carrying out the journey.
In the event of cancellation by Asia Top Travel, clients will receive a full refund of all prepaid payments made to Asia Top Travel.
3. MODIFICATION /AMENDMENTS:
3.1. Modification by client:
a) Clients can request to modify their trip anytime with payment. Asia Top Travel reserves the right to charge for the costs generated by any modification. Asia Top Travel will endeavour to respond to the modification request within the time limit available to secure changes to the required services.
b) Postponement or change of arrival date is considered as a modification. Cancellation of any number of participants is not considered a change. The cancellation policy will be applied for the number who cancel as well as a re-quote of the rate for the remaining participants.
3.2. Modification by Asia Top Travel:
Asia Top Travel reserves the right to modify the services included in the final travel program in the following cases:
a) The modification is justified following an event of force majeure (as mentioned in section 2.2). Depending upon the circumstances the change may result in additional charges to the clients or a refund from Asia Top Travel.
b) The change is essential to ensure the clients’ safety and/or the quality of the trip. In these cases, any additional costs occurred will be charged by Asia Top Travel
4. INTERRUPTION AND UNUSED SERVICES:
Asia Top Travel will not reimburse the services included in the program if they were not used by clients. However, if the trip is interrupted for any reasons related to the health of clients, Asia Top Travel is committed to doing its best to obtain a partial or total refund for the cancelled services from service providers.
5. CLIENTS OBLIGATION AND INSURANCE:
5.1. Before the trip, it is the clients’ responsibility to ensure that they meet the requirements in terms of:
· Passport: (validity of 6 months after return, at least 2 blank pages, children, etc.)
· Physical condition, vaccinations, preventive treatments…
· Visas (required for Vietnam, Laos, Cambodia, Thailand and Myanmar)
Asia Top Travel can offer assistance to clients in the process of obtaining a Vietnam visa (on request)
5.2. Insurance:
All participants in a trip organized by Asia Top Travel must obtain international travel insurance covering at least medical expenses and repatriation.
The insurer’s name and contact information and the clients’ insurance policy number must be sent to Asia Top Travel before the commencement of the trip.
5.3. During the trip, clients must follow rules announced by the tour guide or by any other agent of Asia Top Travel. These are rules to ensure clients’ safety and the quality of the travel program.
5.4. Assistance: Asia Top Travel undertakes to provide all necessary on-site and useful assistance to the clients in the event of an incident covered by travel insurance and in particular to assist the clients in completing administrative formalities with local authorities and the insurer.
6. LIMITATION OF LIABILITY:
6.1. Asia Top Travel undertakes to provide all the services agreed with the latter and included in the travel program.
6.2. Clients are responsible for all actions: Any activity that does not fall within the scope of the travel program or any violation of the law of the host country will not be the responsibility of Asia Top Travel.
6.3. Asia Top Travel acts for clients as an intermediary between the various service providers (Airlines, hotels, restaurants, boats…) to ensure a certain quality of services. However, cannot be responsible for the actions of various providers who retain their own level of responsibility.
6.4. Asia Top Travel is not responsible for incidents due to any Force majeure.
